Generic drug makers continue to be the subject of class action litigation alleging they illegally colluded to fraudulently inflate prices of essential drugs.
Generic drug makers continue to be the subject of class action litigation alleging they illegally colluded to fraudulently inflate prices of essential drugs. This most recent complaint claims numerous companies worked together to fix the prices of divalproex sodium extended-release tablets, which are used to treat seizure disorders.
The cast of defendants is similar and will most likely remain so as more class actions are filed over alleged generic drug price-fixing. The complaint lists the following as defendants:
- Dr. Reddy’s Laboratories, Inc.
- Impax Laboratories, Inc.
- Mylan Inc.
- Myland Pharmaceuticals Inc.
- Par Pharmaceutical, Inc.
- Par Pharmaceutical Companies, Inc.
- Zydus Pharmaceuticals (USA) Inc.
According to the 51-page lawsuit, the anticonvulsant underwent sharp price increases of more than 500 percent, the result of an intricate anticompetitive conspiracy among the defendants.
