WellNow Urgent Care resolves class action lawsuit over an alleged April 2023 data breach with $4.4 million payment.
A $4.4 million settlement resolves a class action lawsuit against WellNow Urgent Care, P.C. over an April 2023 data breach in which an unauthorized party accessed files containing the personal information of roughly 597,000 people.

The WellNow data breach settlement received preliminary court approval on April 1, 2025 and covers all United States residents whose personal information was leaked or accessed in the data breach incident.
The court-approved website for the WellNow data breach class action settlement can be found at WellNowDataSecuritySettlement.com.
For the WellNow data breach settlement, the compensation a class member may receive will depend on whether their Social Security number (SSN) was accessed in the cyberattack, along with other personal data.

WellNow class members who submit a timely, valid claim form can receive up to $25 an hour for time spent dealing with the effects of the data breach, with a cap of two hours if your SSN was not accessed and up to three hours if your SSN was accessed.
Further, all class members may submit a claim form for reimbursement of up to $7,500 for “extraordinary out-of-pocket expense[s]” for data breach-related losses and costs, such as unreimbursed fraud or identity theft losses, attorney and accountant fees, credit reporting fees, costs associated with freezing or unfreezing credit, and credit monitoring expenses.
Class members are required to submit proof of costs and/or losses to receive reimbursement for “extraordinary” out-of-pocket expenses, the settlement website stipulates.
Alternatively, those whose SSN was accessed in the WellNow data breach may, instead of reimbursement for extraordinary out-of-pocket losses, opt to receive a pro-rated cash payout from the settlement fund. This amount will be determined after reimbursement for extraordinary out-of-pocket expenses and is mutually exclusive with claiming reimbursement for extraordinary out-of-pocket losses.
Documented proof of losses is required, and losses must be fairly traceable to the data breach incident to claim the alternative cash payment option.
A claim form is available to fill out and submit online via the “Submit Claim” section of the settlement website. To do this, you will need your Class Member ID, which can be found on your original settlement notice.
Alternatively, a PDF of the non-SSN claim form and a PDF of the SSN claim form are available to download, print, fill out and mail to the address listed on the first page of the forms.
All WellNow claim forms must be submitted by July 11, 2025.
The defendants who have agreed to the class action settlement are:
- WellNow Urgent Care, P.C.;
- Immediate Care, L.L.C.;
- Physicians Immediate Care Chicago, P.C.;
- Aspen Dental Management, Inc.; and
- Admi Corp. d/b/a TAG The Aspen Group.
A court hearing is scheduled for August 15, 2025 to determine whether the WellNow settlement will receive final approval. Should final approval be granted and all appeals resolved, compensation will begin to be released to eligible class members who submitted a timely, valid claim form.
The class action lawsuit against WellNow Urgent Care, P.C. alleged that a data breach occurred in April 2023 in which an unauthorized party gained access to customers’ personal information, sometimes including social security numbers.
