Attorneys working with ClassAction.org are gathering users of Byte dental products to take legal action in light of reports that the aligners and impression kits may not be as safe and effective as advertised.
In October 2024, Straight Smile LLC (doing business as Byte) and Dentsply Sirona suspended sales of their Byte aligners and impression kits to conduct “a review of certain regulatory requirements related to these products.” According to a lawsuit filed against Byte several months later, hundreds of Byte users have reported adverse events and dental injuries associated with the products, including allergic reactions, bite misalignment, bone loss, broken or chipped teeth, facial swelling, worsening bite, gum recession, locked jaw, loosening of teeth, tooth discoloration and more.
The attorneys believe people who purchased Byte dental products may have been misled about their safety and efficacy and could have claims worth $100s under false advertising and consumer protection laws.
The attorneys are also gathering people who experienced dental injuries after using Byte products to take legal action. These users may be able to recover money for medical expenses and other related losses.

Byte Aligners Lawsuit
The Byte false advertising lawsuit, filed in March 2025, claimed the company’s dental products have been proven ineffective and dangerous. Despite Byte’s representations to the contrary, consumers’ purchase and use of the aligners and impression kits were “not sufficiently overseen, reviewed, or directed by a medical professional,” according to the case.
The lawsuit claimed that between October 2020 and October 2024, “hundreds of incidents involving adverse events” related to Byte products were reported, indicating that they “lacked sufficient medical oversight” and were falsely advertised as safe and effective.
After suspending sales in October 2024, Byte admitted in a notice posted on its website that during a review of medical device reports related to the Byte aligner product and a consultation with the FDA, the company determined that its patient onboarding process may not have adequately ensured that “certain contraindicated patients” did not start treatment with Byte aligners. The notice went on to warn patients to stop treatment and see a dentist if they are an adolescent with a skeletally narrow jaw or if they have periodontal disease, severe open bite, severe overjet, tooth malocclusion requiring surgery, mixed dentition or dental prosthetics or implants.
The lawsuit claimed that despite these “concerning admissions,” Byte has provided no further information to patients and has not offered a refund to consumers who purchased the allegedly defective products.
Byte Aligner Injuries and Complications
According to the Byte lawsuit, patients have reported experiencing the following dental injuries and complications after using Byte aligners and impression kits:
- Allergic reactions
- Bite misalignment
- Bone loss
- Breaking and chipping of teeth
- Choking on improperly fitted aligners
- Cutting of gums on aligners
- Facial swelling and mouth abscess
- Gum recession and flaring of teeth
- Jaw clicking
- Locked jaw
- Loosening of teeth
- Loosening of veneer
- Periodontal disease
- Pulp necrosis resulting in a dead tooth
- Severe open bite
- Tooth discoloration
- Tooth fracture
- Worsening of bite
The attorneys believe that those who experienced these or other injuries after using Byte products may not only be eligible for a refund but could also seek reimbursement of their medical expenses.
Is This a Lawsuit? What Am I Signing Up For, Exactly?
You are not signing up for a lawsuit, but rather a process known as mass arbitration. This is a relatively new legal technique that, like a class action lawsuit, allows a large group of people to take action and seek compensation from a company over an alleged wrongdoing. Here is a quick explanation of mass arbitration from our blog:
“[M]ass arbitration occurs when hundreds or thousands of consumers file individual arbitration claims against the same company over the same issue at the same time. The aim of a mass arbitration proceeding is to grant relief on a large scale (similar to a class action lawsuit) for those who sign up.”
Byte’s terms of use contain both a class action waiver and an arbitration clause requiring users to resolve disputes via arbitration, a form of alternative dispute resolution that takes place outside of court before a neutral arbitrator, as opposed to a judge or jury. It’s for this reason that attorneys working with ClassAction.org have decided to handle this matter as a mass arbitration rather than a class action lawsuit.
How Much Does This Cost?
It costs nothing to sign up, and you’ll only need to pay if the attorneys win money on your behalf. Their payment will come as a percentage of your award.
If they don’t win your claim, you don’t pay.
How Much Money Could I Get?
There are no guarantees as to how much money you could get or whether your claim will be successful. However, consumers who take action for potential violations of false advertising and consumer protection laws could have claims worth $100s.
Those who have experienced injuries may also be able to recover money for their medical bills and related losses.
