Whole Foods Settles Price Labeling Lawsuit

Whole Foods reached a deal dismissing a proposed class action, which accused it of failing to display prices for certain items in violation of New Jersey’s Consumer Fraud Act. Class certification failed because the plaintiff could not link Whole Foods’ alleged violation to any actual harm. Whole Foods claimed that if the prices were objectionable, it would not have been out of the question for the plaintiff to leave the items at the register upon discovering their price. According to the deal, the opportunity for another customer to file a lawsuit still stands.
