Wheelchair Accessibility and Nissan Car Fires This week’s issue covers four recent investigations, starting with one launched over the accessibility barriers wheelchair users may face at some nursing homes and medical facilities. From there, we’ll take a look at ABS actuator pump issues in certain Nissan and Infiniti vehicles and whether several rounds of recalls were enough to adequately address a potential fire hazard. Our Texas readers will want to check out our third story, as attorneys investigate whether some insurance companies are violating state law by requiring patients to pay out of pocket for mammograms and/or diagnostic breast imaging. And, for those closer to the northern border, this issue’s final piece centers around the sales emails Rugs.com sends to Washington residents – and whether they’re potentially misleading. As always, you can read up on the details and find the latest in class action settlements just below. - Kelly Mehorter, Writer | Attorneys working with ClassAction.org have opened a new investigation to see if lawsuits can be filed on behalf of wheelchair users who’ve faced accessibility barriers at a nursing home, assisted living facility or other medical establishment. They have reason to suspect that some facilities nationwide may lack the proper policies, equipment and procedures needed to provide patients who use wheelchairs with the same access to care as everyone else. If you’ve faced a challenge like this, it’s possible that your rights under the Americans with Disabilities Act may have been violated. Visit this page to learn more about the ongoing investigation, common barriers and how you may be able to help enact change in the industry. | Nissan Fire Investigation Looks into Vehicles Affected by ABS Actuator Recalls A number of Nissan and Infiniti vehicles were recalled in 2016, 2018 and/or 2019 over a problem with the anti-lock brake (ABS) actuator pump, which can cause brake fluid leakages, electrical shorts, and, in some instances, fires. Despite these measures, attorneys are concerned that the issue may not have been fully addressed and want to file a class action lawsuit to help affected drivers recover money for expenses not covered by the recalls—including reduced vehicle value, rental car costs and more. If your vehicle was subject to Nissan’s ABS actuator recalls, check out our page to see how you can help the investigation. | ~ In Other News ~ Texas residents: Have you paid an out-of-pocket cost for a mammogram or diagnostic breast imaging since January 2022? If you also had health insurance at the time, you may be able to help get a class action lawsuit on file. Texas law requires certain health plans to provide coverage for these exams—but attorneys believe some insurers may be refusing to comply. If successful, a lawsuit could help Texas patients get back some of the money they spent on mammograms and diagnostic breast imaging and force insurance companies to provide proper coverage for these screenings moving forward. Head to this page for the details. | Recipients of Rugs.com’s marketing emails may have noticed that the company seems to regularly offer great deals—but could it be too good to be true? Attorneys working with ClassAction.org seem to think so. They believe the retailer may have violated Washington state law by emailing residents about “limited-time” sales that are regularly extended or never actually end, potentially misleading consumers. They’re now looking to hear from Washington residents who get emails from Rugs.com to determine whether a class action lawsuit can be filed. You can read up on the investigation here. | ~ Forward to a friend ~
