A lawsuit has been filed for unpaid overtime claims on behalf of inside sales representatives at Vytl Controls Group and its subsidiaries, and attorneys working with ClassAction.org are now looking for more people to come forward to help strengthen the case.
Specifically, the unpaid overtime lawsuit claims Vytl Controls Group, a supplier of pipes, valves, fittings, actuators and engineered solutions in the flow control industry, misclassified inside sales representatives as exempt from receiving overtime pay even though they do not fall under any of the exemptions listed in the federal Fair Labor Standards Act (FLSA). According to the case, inside sales representatives at Vytl Controls should be paid one-and-a-half times their regular pay rate, including bonuses, for all hours worked in excess of 40 each week.
The lawsuit is aiming to help workers get back any money they may be owed for unpaid overtime claims, and those affected can now sign up to join.
If you work or worked as an inside sales representative (or in a similarly titled position) at Vytl Controls Group, W&O Supply, A-T Controls, Setpoint Integrated Solutions or Valsource and put in more than 40 hours in at least one week in the past three years, fill out the form on this page to learn what you can do.
Vytl Controls Group Unpaid Overtime Lawsuit
The Vytl Controls Group lawsuit, filed on July 3, 2025, claims the company and its subsidiaries intentionally misclassified inside sales representatives as exempt from overtime in order to avoid their obligation under the Fair Labor Standards Act (FLSA) to pay employees time-and-a-half wages for all weekly hours worked in excess of 40.
According to the lawsuit, inside sales representatives do not qualify for any exemptions under the FLSA, which entitles employees to certain protections like minimum and overtime wages unless they meet specific criteria. For instance, although the FLSA exempts certain outside sales employees from overtime requirements, inside sales representatives at Vytl Controls Group do not regularly make sales away from their employer’s place of business and thus do not fall under the FLSA’s definition of outside sales employees, the lawsuit alleges.
Moreover, the case claims inside sales representatives do not meet the requirements for the FLSA’s executive or administrative exemptions for the following reasons:
- They do not supervise other employees;
- Their primary duty of generating sales is not directly related to the management of the company’s business or customers, or their general business operations;
- They do not regularly exercise independent judgment and discretion with respect to significant matters (e.g., pricing and sales margins) and must follow company policy;
- They are closely supervised by managers; and
- They are subject to the same policies and procedures regardless of location.
The plaintiff, who has worked for the defendants since June 2021, says he and other inside sales employees regularly work 50 to 55 hours per week and are paid an annual salary plus quarterly sales incentive bonuses.
Importantly, workers who are paid on a salary basis are not automatically disqualified from the FLSA’s overtime requirements just because they receive a salary.
The lawsuit argues that Vytl Controls Group’s inside sales employees should have been paid overtime at a rate of one-and-a-half times their regular pay rate, calculated by dividing their total compensation for the workweek (including nondiscretionary sales incentive bonuses) by the number of hours actually worked.
According to the lawsuit, Vytl Controls Group and its subsidiaries “willfully” violated the FLSA and “knew, or absent their own recklessness should have known” that inside sales employees were entitled to overtime pay.
How Could a Lawsuit Help?
If successful, the lawsuit could help current or former inside sales representatives get back any money they may be owed for unpaid overtime claims. It could also force Vytl Controls Group and its subsidiaries to change their pay practices.
