Frequently Asked Questions About This Settlement
What's Going On?
A $3,575,000 settlement has been reached to resolve a proposed class action lawsuit that claimed certain eye products manufactured, distributed or sold by Similasan Corp. were deceptively labeled and advertised as homeopathic when they had not obtained the appropriate approvals from the FDA and were not manufactured according to Current Good Manufacturing Practices.
The lawsuit further alleged that the products were misleadingly marketed as sterile and failed to warn of the risks of silver sulfate, an ingredient that can decrease night vision and cause irreversible eye and skin discoloration. Similasan denies each of these allegations.
Who’s Covered by the Settlement?
The settlement includes those who purchased, for personal use and not for resale, any of the eye products covered by the settlement between September 11, 2017 and February 20, 2025.
Which Eye Products Are Covered by the Settlement?
The settlement covers homeopathic eye products sold under the following brand names: Similasan Dry Eye Relief; Similasan Complete Eye Relief; Similasan Allergy Eye Relief; Similasan Kids Allergy Eye Relief; Similasan Red Eye Relief; Similasan Pink Eye Relief; Similasan Kids Pink Eye Relief; Similasan Aging Eye Relief; Similasan Computer Eye Relief; Similasan Stye Eye Relief; Similasan Pink Eye Nighttime Gel; Similasan Dry Eye Nighttime Gel; CVS Pink Eye Drops; Walgreens Stye Eye Drops; Walgreens Pink Eye Drops; and Walgreens Allergy Eye Drops.
How Do I File a Claim with the Settlement?
You can visit the court-ordered settlement website and complete a claim form online. Simply click here to get started.
Alternatively, you can print out and mail a claim form to the settlement administrator.
Is the Settlement Website Legit?
Yes. It has been designated by the court as the official website for the settlement and where consumers will need to go if they want to submit a claim online. The site also provides answers to frequently asked questions, important documents, and more.
How Much Could I Get?
The amount you could receive from the settlement will ultimately depend on how many products you purchased, whether you have proof of your purchases, how many claims are ultimately filed in the settlement, and final approval of the settlement by the court. Claims are limited to one per household.
Consumers submitting claims without proof of purchase will be eligible to receive $2.50 per covered product for up to four products. Those who have proof of purchase can receive the same amount per covered product, with no cap or limitation.
Payouts to valid claimants may be subject to a pro rata adjustment. If the amount required to pay all approved claims exceeds the amount of money available after administration costs, fees, and other expenses are paid, class members’ awards will be proportionately reduced. If the amount left in the settlement fund is greater than the amount needed for approved claims, each award will be increased proportionately.
When Will I Get Paid?
Payments will not be issued until the court approves the settlement as final. The settlement website notes that it is unknown how long this will take and whether any appeals will be filed, asking that consumers be patient and check back to the site for updates.
What’s the Deadline for Filing a Claim?
Claims must be submitted online or postmarked by October 15, 2025.
