Attorneys working with ClassAction.org are looking into whether a class action lawsuit can be filed in light of the Marathon Health data breach.
As part of their investigation, they need to hear from individuals who had their information exposed in the incident, including those who received notice of the Marathon Health data breach or otherwise believe they are affected.
Marathon Health Security Incident: What Happened?
Marathon Health, an employer-sponsored healthcare provider serving millions of patients nationwide, has reported a data breach involving the information of employees and family members enrolled in participating health programs.
According to a sample notification letter sent to potentially affected individuals, shown below, Marathon Health was alerted to suspicious activity related to an employee account on August 24, 2026.
After disabling the account and investigating the activity with cybersecurity professionals, the company determined that an unauthorized individual posing as a Marathon IT worker was able to obtain the employee's credentials, access a cloud-hosted application and export the information therein. Marathon Health then assessed the scope of the incident and, on September 9, validated that personal information was obtained by the unauthorized individual.
Information that may have been exposed in the Marathon Health data breach, varying by individual, included names, dates of birth, contact information and Social Security numbers.
An October 30, 2026 report submitted to the Texas Attorney General's Office stated that the incident may have additionally involved medical information and health insurance information and affected over 230,000 Texans.
The Marathon Health data breach was also reported to the Vermont Attorney General's Office and the Massachusetts Office of Consumer Affairs and Business Regulation on October 30; thousands of residents in both states were impacted.
