Individual vs. Class Action Pradaxa Lawsuits
Lawsuits involving Pradaxa will not move forward as a class action, but rather proceed in a similar manner known as a Multidistrict Litigation (MDL). Both types of legal actions involve multiple individuals who are making the same allegations against the same defendant. In the case of Pradaxa, patients who suffered severe bleeding on Pradaxa are claiming that the maker of Pradaxa, Boehringer Ingelheim, failed to properly warn them about the drug’s risk of irreversible bleeds. The main difference between these two types of claims is that, in an MDL, the plaintiff retains their own individual suit and lawyer, as well as an individual award based on evidence brought forth at their own trial. A class action, on the other hand, results in a single trial and single settlement which is equally shared among the claimants.
MDLs are most commonly used in complex pharmaceutical cases, which will often involve millions of documents gathered to serve as proof in the litigation. In August 2011, a panel of federal judges announced that the Pradaxa lawsuits would proceed as an MDL under the guidance of Judge David Herndon of the South District of Illinois. Over the next three months, millions of pages in documents will be introduced into the case. In a year or so, a panel of judges will choose bellwether cases, which are individual bleeding injuries that are representative of hundreds of claims, according to reports. A judge will then order bellwether trials, for typically three to five cases, to indicate a future trend in litigation surrounding the drug.
