A proposed class action lawsuit has been filed against defendant Genpact Services, LLC claiming the debt collector violated the Fair Debt Collection Practices Act in collection letters sent to consumers. The plaintiff says he received two letters that each specified a “Balance Due” followed by an “Amount Now Due.” He argues that the two differing amounts are confusing because Genpact was unclear as to which amount it is attempting to collect. “Both amounts cannot be ‘due’ at the same time on the same account,” the suit claims. The letters allegedly lack information that would allow the recipient to make an informed decision about how to respond to settle his or her account.
