A former employee has filed a proposed class action against The Wireless Center, Inc. claiming the company misclassified its managers and managers-in-training.
A former employee has filed a proposed class action against The Wireless Center, Inc. claiming the company misclassified its managers and managers-in-training as a means to avoid paying overtime wages. The 11-page lawsuit alleges the plaintiff and similarly situated workers had managerial job titles even though they never so much as supervised the work of at least two other full-time employees or met any of the other benchmarks set by the Fair Labor Standards Act (FLSA) for individuals to be considered exempt from overtime pay.
According to the plaintiff, managers and managers-in-training were paid by the defendant on a flat salary plus commissions basis without receiving time-and-a-half for any hours worked over 40 in a week. Furthermore, the plaintiff claims the defendant had a policy of staffing stores with the express goal of avoiding employees accruing any overtime hours.
