Mississippi Limestone Corp. and an owner/manager of the company are facing a proposed collective action claiming that they violated federal law by failing to pay proper overtime wages. The plaintiff claims she worked as a laborer for the defendants, often in excess of 40 hours per week. She estimates that she worked approximately ten hours of overtime each week, but was never paid any extra for this time. In fact, the suit claims the defendants “intentionally manually manipulated and reduce [the] plaintiff’s actual work hours to avoid their obligation to pay overtime.” The suit hopes to cover all non-exempt employees who worked for the defendants within the past three years and who were not paid overtime.
