A class action out of New York alleges K Zark Medical P.C. and its owner violated the Fair Labor Standards Act (FLSA) by failing to pay workers at the proper time-and-a-half overtime rate. Filed on behalf of anyone employed by the defendants within the last six years, the 15-page complaint claims the plaintiff, an hourly employee, was paid a flat rate regardless of how many hours she worked. The plaintiff alleges she regularly worked up to 45 hours per week without receiving the proper overtime rate for all hours worked over 40. Furthermore, the lawsuit claims proposed class members were never provided mandatory wage statements.
