Allegedly, JM Eagle committed unfair business practices by marking its PVC pipes as approved by a number of certification groups, including Underwriters Laboratories, even though the product did not meet stress tests. The plaintiff in the JM Eagle class action claims that he bought the JM Blue Brute C900 PVC pipe, which contained a UL Mark, indicating that it passed a number of tests, including one measuring longitudinal tensile strength (LTS); however, all of the Blue Brute pipes manufactured between 1997 and 2005 did not pass the LTS test, according to the JM Eagle class action suit.
